Do I have to repay my medical insurance company after I recieve a settlement from my car insurance company?

09 Jun

I was not at fault in an accident and had sustained multiple injuries. I had quite a bit of medical bills. My own medical insurance company has covered all of my bills. Will they try to get reimbursed after I settle with my auto insurance? How do they even find out about my settlement?

recently I got into an car accident, can lawyer take an percentage on my medical and rental car expanse?

03 Jun

recently I had a car accident, a semi truck rear ended me totaled my car, I had neck injury. the lawyer recover $7500 for me(included all medical, car rental expense), he want to charge me $2500 33.3 % of the settlement . But however my medical expense is $3500 and my rental car car expense is $800. This basically leave $700 for my wage lost and other pain and suffering. my question is can lawyer take a percentage on my medical bill, rental car which in my opinion those arematerial demage, and I think they should just take the percentage from my wage, pain and suffering demage. Please advise regards
David
Well medical expense and car rental expense I could recover without lawyer. Because these arewith a fixed cost. I had an accident 10 years ago and I just files the cliam against the other party’s insurance company. They assign me a rental car the very next day, and also they pay for my emergency room visit. since this time my accident was more serious I hire a lawyer. but however he didn’t get me a rental car the lawyer ask me to go rent car out of my pocket first which I think their motive is take a percentage on my rental car expense they recover. so that why I think why should take a percentage on my rental car expense (they couldn’t get a settlement for the demage of my car for 4 weeks so I had to paid 800 dollar for rental car the lawyer could’ve just ask the insurance company to rent a car for me) and medical expense is fixed cost as well. the motive is truly questionable

Auto accident medical expenses law suit..What option do we have to stay away?

01 Jun

Five years back, my wife had involved in an auto accident at an intersection when she attempted to make left turn. There was a minor damage to both cars. We exchanged the insurance details. No one got injured. Cops came and gave ticket to my wife. We went home and everything went smooth that day. After 5 years, we got a call from our insurance company and they mentioned that the other party is suing my wife for medical expenses for about 80K. We had a nice insurance coverage then. It appears that they want to milk money from insurance company. Now we got letter from an attorney that was selected by our insurance company. Now we are moving out of that state, and we have lot of other worries. Because of this latest development, we are stressed, unrest and worried. What legal protection that we have now? Why does the insurance company not settle the issue? We don’t want to spend any time, money and energy in this matter. What we should do now to stay away from this? Is it necessary for us to file a counter law suit against the other party as well as our insurance company for not taking care of us by settling the insurance claim with other party? Please advise.

Thanks.

How can I locate a professional to provide a medical disability assessment for an insurance settlement?

29 May

I need to find an independent, qualified person/service to provide expert testimony for an insurance settlement case. Specifically, to provide an assessment of the nature, extent, and prognosis of injuries I sustained in an auto accident – with the possibility of using this information if the case goes to court. I have looked online for “disability assessments”, “disability profiles”, etc., but am not finding anything in my local area (Portland, Oregon). Any suggestions?

Insurance Settlement – Are medical bills and pain in suffering in the same check?

27 May

I was in a car accident and the other driver was at fault. I have received money for my car and am awaiting the settlement paper work to finalize. Will the insurance company pay my medical bills for my injuries AND pain and suffering or will they just give me money for pain and suffering and expect to pay my medical bills from that?

In an Auto Accident claims settlement, are medical bills settled at the adjusted rate or the invoice bill?

24 May

My health insurance paid my bills in an auto insurnace. The other party’s auto insurance is ready to settle but is willing pay the ‘negotiated rate/adjusted rate’ that my health insurance paid for and not the invoiced rate.

Ex. The actual MRI was billed at $1700 but the negotiated rate my health insurance paid was $400

Secondly, they are paying only 80% of lost wage

They are saying that this legally true citing House Bill 4.

Is this true?

I was under the impression, that they need to pay the total medical expenses (not the negotiated rate) and the total lost wage (not the 80% crap) plus pain and suffering

Please help and guide me

Thanks!
Is it a law to pay 80% of lost wage?
How much would be an appropriate Pain and suffering offer, if the special damages (medical and lost pay) is $6200
Because I pay a premium to my health insurance , we get a discounted rate – would the other party pay more considering I pay a premium every month to get the discounted medical rate?
I live in Texas, is there any specific law for texas?

How can I avoid submitting certain medical records and not compromise my mva personal injury claim?

23 May

In California, I’ve filed a personal injury auto accident claim and need to release my medical records to the insurance company. I’m only claiming physical injury, not psychological/emotional but the doctor who is treating me for pain with alternative treatments such as biofeedback is also my therapist. His notes from our appoinments contain co-mingled info and I don’t want to submit my personal mental health information. His physical pain treatments are important to my case and I’d like to know if there is a way around this?

Injury settlement. Will insurance still pay for any furhter medical problems as a result of the injury?

22 May

In anticipation of an injury settlement offer regarding a slip and fall injury within a grocery store, I am interested in the ramifications of accepting a settlement. The insurance company will be reimbursed upon settlement for expeses they have paid to date. My concern is will they pay any further claims related to this injury once we have accepted a settlement from the grocers insurance company. The injured party has already had a procedure done on her lower back which has given her significant relief. However, it still flares up on occasion and we feel it is not a question of if she will need further medical intervention, but when. Any advice from those that are in the know about such things will be greatly appreciated. Thank you!
