I already have an attorney and after a year of the insurance company denying my claims, this attorney got a reconstructionist company to look at my case, because in Colorado you have to prove the liablitiy of the other person, especially when the cops don’t give out a ticket. This company wrote a complimentary letter stating 100% of the liablitiy was this girl’s. So now the insurance compnay wants us to put together a settlement amount to present them with & not file the lawsuit right now. We have a great chance to settle very soon, but I know I need to have money for a future surgery and ongoing therapy and medications probably for the rest of my life. My spine doc said for me to use therapy and anything else to help me cope with pain until I can’t ake anymore & then surgery. This is because I am only 36 & in good shape, the advise me to try & cope as long as possible as there are new alternatives delveloping. I don’t want to be fused.

Will you have to pay back your personal medical insurance after receiving money on an auto injury claim?
Medical bills didn’t exceed $800! I have really good medical coverage from my company and they have covered everything from the accident. I will be receiving a settlement check and was just wondering if I need to payback my medical insurance in the state of California……..

How much “pain and suffering” money to expect from an insurance settlement?
My wife was hit by another car about a year ago. She broke two fingers, which sounds trivial, but they were broken quite badly. She had one surgery where pins were inserted to heal the bones, and another to extract scar tissue that was limiting her movement. She was in hand therapy for a year, but she still doesn’t have anything close to full movement in the hand with the broken fingers — sometimes she needs help cutting a piece of chicken at dinner and things like that.
I estimate that the insurance company paid out about $20k for the hand therapy and another $20k for the various surgeries and doctor’s visits.
I assume they’ll be offering a pain and suffering settlement in the near future. How much should we expect? How will we know if they’re lowballing us? If I’m pretty sure they are trying to screw us over, is it acceptable to tell them we’ll get a lawyer if their offer isn’t more reasonable?
Question to reece010: Is that 50k on top of the medical bills (if the medical bills are 40k)? Or does that include the bills?

1) Is she left or right handed?
Right.
2) Which hand was injured?
The ring and pinky fingers on her left hand. (And movement on the middle finger is also limited.)
3) Does she work outside of the home?
She’s in college and will work outside the home in the future.
4) What is the prognosis for a complete recovery?
Not going to improve further. It may in fact worsen in time.
5) Does she have scarring?
There’s a thin scar running down her ring finger, which was broken the worst.
6) Age?
24.
7) Attractive? (relevant for scarring)
Her hands were fine before, now the fingers are *slightly* mangled, enlarged, and lightly scarred.
Trouble completing her daily activities?
Initially yes, now it’s only occasional tasks like cutting a piece of meat. She’s figured out how to drive and type well enough.
9) Whole or partial AMA disability rating?
I doubt there would be one.
When you get an insurance settlement after a fire, can you use the money to buy a new home instead of rebuild?
home caught on fire . No one was in it. They believe they will be offered a settlement by their insurance company. Do they have to use it to rebuild, or can they demolish the burned house and sell the lot and then buy another house somewhere else?

Shortly after I signed the contract I was interviewed by assigned attorney who later Quit firm and all my concerns where directed to a Paralegal who hardly impressed me when she exclaimed to me that she felt my injuries were inconsistent with the damage of my vehicle? I explained to her had she done her homework and learned that the first vehicle (One of two) that rear-ended me, a lifted-truck was equiped with a Bull-Bar! She was quite adament thru the tone of her voice that injuries I sustained were exaggerated even past the point she admitted not knowing what a Bull-Bar was? I became very aggitated and demanded a different Paralegal they quieted my concerns and kept her in place as my Para-Legal after a year and about 3 months she was fired for incompetency! I got a call from the new Para-Legal who was brought in the 4th Quarter and really hasn’t a clue? Can I fire Law-Firm?

I went to the er that day for back pain, then again on the 1st, i have been to the doctors 3 times, referred to see a chiro, that didn’t help so they scheduled me a mri. after reviewing that they now have me in physical therapy.
