I have an incredible mess. I had an automobile accident and was not insured. The man is now suing me. My primary home is currently in foreclosure but I have a 2nd home (paid for) that I just moved into and have yet to homestead it. My question is if I file for bankruptcy, will this protect the home I am now living in? What about a trust or transfer of property? Can I still get the house homestead and will this protect me? What can I do to prevent a forced sale should a lien be placed on the house in a judgement? Please help, I’m currently an unemployed single mother and very scared.

I was involved in a car accident and substained injury to my knee. I was awarded $25,000 for pain and suffering. My attorney is giving me $6,500, keeping 75%! This seems ridiculously high, how much can lawyers charge? I was under the impression that no more than 35%.

These lawyers claim to be good hearted individuals who are only interested in pursuing justice. To prove their commitment, they are willing to work for free until a favorable settlement is achieved. What cash poor accident victim could refuse such a noble proposition?
Please consider: Nobody works for free.
These lawyers are able to cherry pick their cases based upon how lucrative their practices are. No competent lawyer will accept a personal injury case unless they are sure of a settlement. Also consider that the lawyer will typically receive 60% of the settlement plus their expenses (taken off of the top). The kindly lawyer will end up receiving upwards of 70% of the settlement, leaving a miserable ~30% for the person who actually was injured (talk about adding insult to injury).
If you doubt me, then just try to hire a personal injury attorney on a hourly basis. They make so much more by working on “CONTINGENCY” that you won’t have any takers.
Gunny T: You are incorrect. I am making no assumptions regarding juries, judges or attorneys in general. I am specificly questioning the motives and manner in which PERSONAL INJURY attorneys operate.
Sounds to me like you are making some assumptions yourself.
1) Are you absolutely positive that the plantiff’s attny was working pro bono vs on contingency?
2) How do you know that the jury voted against a just decision in order to watch television?
It sounds to me as if you are a little biased as to your specific case. Perhaps you were the plantiff?

We have been dealing with a personal injury lawsuit for about two years. The accident occurred in CA and we reside in another state, so we are dealing with our attorney all long distance. The case has been complicated, mainly due to an inattentive attorney from the start, whom we fired. We retained our current attorney not too long ago and the case against the defendants insurance company has been resolved and funds have been sent to our attorney. Here is where it becomes tricky. The funds for my settlement have been sent to us, the attorney is holding the funds from my husband’s portion of the settlement until a settlement is reached with our insurance company (the defendant was an underinsured driver, we had underisured driver coverage). Our attorney claims he cannot release these funds because he will more than likely need to spend the money on litigating the case against our insurance company..and it just does not make sense to me. In our eyes, the case against the defendant is closed (and in the courts eyes) I don’t see why the funds cannot be released, but my attorney alleges this is normal practice in personal injury law. Anyone have any experience with a situation similar to this? Thanks.

I was in an auto accident and hired a lawyer to represent me. The insurance companies are (mine & the other motorist) are investgating in order to determine who is at fault… Meanwhile, I’m asking my attorney to see if the other motorist has full coverage, liability, etc… so I can have an idea as to how things are going to play themselves out in regards to my medical bills, and other compensation, etc… The attorney claims that he can’t get the details of the other motorist’s insurance policy to answer my questions. This doesn’t sound right to me. Shouldn’t he, not only be able to obtain their policy, but be working diligently, early on in the process, to obtain this information so he can guage the “possible” compensation that, not only myself, but the docter & himself (the lawyer) may receive? …my injury is a life altering injury and I need to know what options I have in regards to my medical & all other compensation I may be entitled to. I am not the type to blindly allow my lawyer to do as he chooses, while I remain in the dark as to the facts regarding my situation. Please enlighten me…

my wife was run off the road by a semi (he was sighted for improper lane change) there insurance company is going to offer a settlement how much should we be looking for? Her vehicle flipped 3 times (they paid us $8000 for it KBB value) her hospital bill was $11000 (they said they would cover it) It included an ER visit overnight stay. We are fortunate she has no broken bones no nothing physically however she had amnesia and a concussion and still has some neck pain and is freaked out to drive especially at night? we talked to a lawyer but i didnt ask (didnt know if it was proper to ask how much we should be getting) so just seeing if anyone knows? thanks
