I was involved in a car accident and substained injury to my knee. I was awarded $25,000 for pain and suffering. My attorney is giving me $6,500, keeping 75%! This seems ridiculously high, how much can lawyers charge? I was under the impression that no more than 35%.

I was in a car accident in October. A lady was arguing with her son and rear ended me at 40 mph. I sustained neck, back, and shoulder injuries. I still have pain in my shoulder that the dr. feels will most likely never be corrected. The insurance co I am dealing with says I deserve no compensation for pain and suffering and their offer is not even enough to cover what it cost me in medical bills, time off work, and dropping class at school. I have never been in an accident before and I don’t know how this works. Do you know what an appropriate settlement would be or how to figure out how much it should be? PLEASE HELP.

My SUV was rear-ended by a tractor trailer on an interstate off ramp 3 months ago. I’m 34 & this was my 1st accident ever. My bumper only had $800 worth of damage. My 10-yr old daughter, 5-yr old son, and I went to the emergency room the next day because we had severe neck & back pain. We were diagnosed with muscle spasm. Two weeks later, my daughter & I started chiropractic care because our pain had not subsided. We went to the chiropractor for 2 months. I was a passenger in my friends truck when he lost control of the vehicle. I woke up face down in the dirt with a truck on my back, I had to flown by helicopter to a hospital an hour away.I had a separated shoulder ac joint which had to operated on, a cracked vertabrate, a collapsed lung, and a couple of broke ribs.I am a self-employed landscaper, and will at least miss out on 12 weeks of work, as of now I have pretty much lost all of my clients. And not real for sure if I will every be able to be as strong, and physically active as I was pre-wreck. As of now my medical bills are near 50,000. I am not trying to get rich but, I want a fair settlement, plus my future in my chosen occupation is somewhat uncertain. Please someone with knowledge on this kind of matter give me some insight.

Once the settlement is agreed on. Is it law that the account has to be set up under a structured annunity account or can the parents set up a trust account at a bank for the child.
The reason for the question is a family friend who is an attorney is Oklahoma handled the settlement for me. However, the law in OK is different and he is not sure how it is handled in GA. He said I may have to now hire an attorney in GA.

I was wondering if there was anyone out there that knew the time line that an insurance company has to make an offer after a car accident? My husband was in a severe accident in December and was not at fault (hit head-on) and the insurance company has yet to make us an offer. Our attorney keeps advising us that it would be anyday now. Should we just be patient or do we need to find another lawyer who will push the insurance company? Also does anyone know the standard for such large settlements? We are concerned that they are not wanting to offer what we feel “helps” get us through this. My husband’s entire face was crushed he ended up with 7 plates and 44 screws in his forehead, not counting the inches of scaring, and the broken teeth.

my wife was run off the road by a semi (he was sighted for improper lane change) there insurance company is going to offer a settlement how much should we be looking for? Her vehicle flipped 3 times (they paid us $8000 for it KBB value) her hospital bill was $11000 (they said they would cover it) It included an ER visit overnight stay. We are fortunate she has no broken bones no nothing physically however she had amnesia and a concussion and still has some neck pain and is freaked out to drive especially at night? we talked to a lawyer but i didnt ask (didnt know if it was proper to ask how much we should be getting) so just seeing if anyone knows? thanks
